Agreement to Terms

By accessing or using monkeyscloud.com and any MonkeysCloud LLC services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use our Services.

MonkeysCloud LLC ("we", "us", or "our") reserves the right to modify these terms at any time. Continued use of the Services after changes constitutes acceptance of the updated terms.

Description of Services

MonkeysCloud provides a vertically integrated developer platform including:

• MonkeysLegion: A high-performance PHP framework
• MonkeysCMS: A headless content management system
• MonkeysMail: Transactional email services
• MonkeysCloud Platform: Hosting, deployment, and infrastructure services

Service availability, features, and pricing may change at our discretion. We will provide reasonable notice of material changes.

Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Distribute malware, spam, or malicious content through our Services
• Use the Services for cryptocurrency mining or resource-intensive non-approved activities
• Reverse-engineer, decompile, or disassemble any part of our proprietary software
• Resell or redistribute our Services without written permission
• Interfere with or disrupt the integrity or performance of our Services

Violation of these terms may result in immediate suspension or termination of your account without notice.

Payments & Billing

• Free-tier services are provided as-is with no SLA guarantees
• Paid services are billed monthly or annually as specified at signup
• All fees are non-refundable except as required by law or stated in our refund policy
• We reserve the right to change pricing with 30 days notice
• Failure to pay may result in suspension or termination of services

Intellectual Property

Open-source components of MonkeysCloud are licensed under the MIT License. Proprietary platform code, branding, trademarks, and content remain the exclusive property of MonkeysCloud LLC.

You retain ownership of all content you create, upload, or deploy through our Services. By using our Services, you grant us a limited license to host and serve your content as necessary to provide the Services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONKEYSCLOUD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Denver County, Colorado.
